These Terms of Service govern your use of Seesail Outreach, a SaaS tool that helps TikTok Shop sellers discover creators and send collaboration invitations.

1. Service Description

Seesail Outreach is a SaaS tool that provides the following features to TikTok Shop sellers:

• Creator discovery and collaboration management via TikTok Shop Partner API — search for creators, send affiliate collaboration invitations, and monitor your own shop's performance analytics
• Email outreach from your own Gmail account — after you connect a Google account under the gmail.send scope, Seesail Outreach can send the outreach emails you have composed, from your own address, on your explicit instruction only

Important: Seesail Outreach is an independent service and is not affiliated with, endorsed by, or sponsored by TikTok, ByteDance Ltd., or Google LLC. Use of TikTok APIs through Seesail Outreach is subject to TikTok's own Terms of Service; use of Gmail is subject to Google's.

2. Eligibility

To use Seesail, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement under the laws of your jurisdiction
• Hold a valid TikTok Shop seller account (or be legally authorized to manage one)
• Agree to comply with TikTok's applicable Terms of Service, Community Guidelines, and Developer Terms

Seesail is not directed to, and must not be used by, individuals under 18 years of age. We do not knowingly permit anyone under 18 to register an account. Registration requires confirming this age requirement before an account can be created (see also Privacy Policy Section 8, Children's Privacy). If we become aware that an account belongs to someone under 18, we will suspend or terminate it.

3. Account & Authorization

• You may only connect TikTok accounts that you legally own or have been explicitly authorized to manage by the account holder.
• If you manage multiple TikTok accounts, each account holder must individually complete the OAuth authorization flow. You may not authorize accounts on behalf of others without their explicit consent.
• You are responsible for keeping your Seesail credentials secure. You must notify us immediately at Mio13266737796@gmail.com if you suspect unauthorized access to your account.
• You may revoke Seesail's access to your TikTok account at any time via Seesail Settings or via TikTok's Connected Apps Settings.
• If you connect a Google account for email sending, you may disconnect it at any time in Seesail Outreach, which revokes the token immediately, or revoke it yourself from your Google Account permissions page.

4. Acceptable Use

By using Seesail, you agree to comply with all applicable laws and the following rules.

4.1 Platform Policy Compliance

• You must comply with TikTok Community Guidelines, TikTok Shop Partner API Terms of Service, and all other applicable TikTok developer policies at all times.
• When you send email through your connected Google account, you must also comply with Google's bulk sender guidelines and with the anti-spam law that applies to you and your recipients.

4.2 Prohibited Content

You must not use Seesail Outreach to send messages that:

• Contain violent, graphic, or otherwise disturbing material that violates TikTok Community Guidelines
• Are sexually explicit or pornographic
• Contain misinformation or deceptive claims, including false statements about your products, your identity, or the terms of the collaboration you are offering
• Infringe the intellectual property rights of any third party, including unauthorized use of copyrighted text, images, or trademarks
• Contain hate speech or incite discrimination or violence
• Promote illegal products, services, or activities (including prohibited substances, counterfeit goods, or financial fraud)
• Constitute undisclosed paid promotion or advertisement in violation of TikTok's advertising policies
• Violate any applicable national or international law or regulation, including anti-spam and personal data protection law

4.3 Prohibited Behaviors

• No spam or unsolicited bulk email — you must not use Seesail Outreach to send repetitive or indiscriminate messages, to send to addresses you obtained from purchased or rented lists, or to keep contacting someone who has asked you to stop. You must honour every opt-out request promptly
• No fake account operations — you must not use Seesail to operate networks of fake, purchased, or inauthentic TikTok accounts
• No harassment of creators — Seesail Outreach's creator discovery, invitation, and email features must not be used to spam, harass, or inappropriately contact creators. Contact details a creator published in their own public bio are for collaboration outreach only, and for no other purpose
• No reverse engineering or circumvention — you must not attempt to reverse-engineer Seesail, bypass rate limits, circumvent security measures, or access Seesail's systems in any unauthorized manner
• No scraping — you must not use Seesail or any API access it provides to scrape TikTok platform data beyond what is returned by authorized API calls
• No redistribution of API data — you must not resell, sublicense, or redistribute any data obtained via TikTok APIs to third parties

5. User Content & Intellectual Property

5.1 Your Ownership

You retain all intellectual property rights in the material (message text, images, product descriptions, and any attachments) that you create in Seesail Outreach and send to creators through it.

5.2 License to Seesail Outreach

By composing a message in Seesail Outreach, you grant us a limited, non-exclusive, royalty-free, revocable technical license solely to store it, render it for your review, and transmit it to the recipients you selected, for the purpose of executing your sending instruction. Seesail Outreach does not claim ownership of your material and does not use it for any other purpose.

5.3 Your Responsibility for What You Send

You are solely responsible for ensuring that:

• You own or have all necessary rights, licenses, consents, and permissions for everything you send, including product imagery, brand names, and any third-party material you quote
• You have a lawful basis to contact each recipient, and that your messages meet the disclosure, identification, and opt-out requirements of the anti-spam and data protection law that applies to you and to them
• The commercial terms you offer a creator (samples, commission, exclusivity) are accurate and are ones you can honour
• You review every message before sending. You remain responsible for the final message, including its factual accuracy

Seesail Outreach is not responsible for any infringement, rights clearance failure, regulatory penalty, or legal claim arising from the messages you choose to send.

5.4 DMCA / Copyright Infringement Notices

If you believe that material sent through Seesail Outreach infringes your copyright, please send a written notice to Mio13266737796@gmail.com containing: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the infringing material with sufficient detail for us to locate it; (c) your contact information; (d) a statement of good faith belief; and (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act. We will respond within 24–48 hours of receipt.

6. Authorization Scopes

Seesail Outreach requests only the minimum scopes necessary for the features you actively use:

• Shop Partner API scopes — seller (shop info), creator (public creator profiles), analytics (your own store data), and collaboration (invitation management)
• Google scopes (openid, email, gmail.send) — only requested if you choose to send outreach email from your own Gmail account. gmail.send grants no read access: we cannot, and do not, read your mailbox. We request no Gmail read scope of any kind

You may review and revoke individual scopes at any time through Seesail Settings, or by visiting TikTok's Connected Apps Settings.

7. Service Limits

• API write operations: Rate limits apply per tenant per minute, consistent with TikTok API constraints and Seesail's fair use policy. Limits may vary by subscription plan.
• Batch collaboration invitations: Limited to ≤ 50 creators per API call, as imposed by TikTok's Shop Partner API.
• Email sending: Sending volume is capped per plan and per period, and is additionally subject to the sending limits Google applies to your own Google account. Seesail Outreach cannot raise those Google-side limits.
• Availability: Seesail Outreach is provided "as is" without uptime guarantees. Scheduled maintenance will be announced in advance where reasonably practicable.

8. Disclaimers

• Seesail is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We do not guarantee the availability or reliability of TikTok's APIs. Disruptions to TikTok's services — including API outages, rate limit changes, or policy updates — may affect Seesail's functionality.
• We make no guarantees about email deliverability — whether a message reaches an inbox, a spam folder, or is rejected outright is decided by the recipient's mail provider and is outside our control. We also make no guarantees about sales outcomes.
• We make no guarantees about creator acceptance rates for collaboration invitations.
• TikTok API data (GMV estimates, follower counts, engagement metrics) is provided by TikTok and reflects what TikTok exposes through its APIs. We do not modify or verify this data.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Seesail and its operator shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of goodwill, or business interruption
• Damages arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages
• Any claims arising from the messages you compose and send using Seesail Outreach, including complaints made to your email provider
• Any actions taken by TikTok, including account suspension, content removal, or API access revocation

In jurisdictions that do not allow exclusion of certain warranties or limitation of certain liabilities, our liability will be limited to the maximum extent permitted by law. Where mandatory consumer protection laws apply (including those in the EU or other applicable jurisdictions), they are not excluded by these Terms.

10. Termination

10.1 Termination by You

You may cancel your Seesail account at any time via Settings → Account. Upon cancellation:

• OAuth tokens for all connected TikTok accounts, and the gmail.send token for any connected Google account, are immediately revoked
• Personal data is deleted as described in our Privacy Policy
• Purge of OAuth tokens completes within 30 days of account closure
• Historical invitation records are anonymized but may be retained for up to 2 years for compliance purposes

10.2 Termination by Seesail

Seesail may suspend or terminate your account if you violate these Terms or TikTok's applicable policies. We will provide written notice where reasonably practicable before taking action, except in cases of serious or repeated violations.

11. Governing Law & Disputes

These Terms are governed by the laws of Thailand, without regard to its conflict of laws provisions. Any dispute arising from or relating to these Terms or your use of Seesail shall be subject to the exclusive jurisdiction of the competent courts of Thailand.

Nothing in this clause affects any mandatory consumer protection rights you may have under the laws of your home jurisdiction (including, where applicable, EU consumer protection laws).

12. Changes to These Terms

We may update these Terms from time to time. For any material change — such as changes to acceptable use rules, liability provisions, or termination conditions — we will:

• Post an in-app notification banner at least 14 days before the change takes effect
• Send an email notification to your registered address at least 14 days in advance

Your continued use of Seesail after the effective date of updated Terms constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using Seesail and cancel your account.

13. Payments & Subscriptions

Paid features on Seesail Outreach are offered as subscription plans (Free, Creator, and Growth tiers) that grant a per-period allowance for creator discovery, contact reveals, and outreach sends. Current plans and prices are always listed on our Pricing page.

• Payment processing. Subscription payments are processed by XorPay, our payment processor, by scanning a QR code with your payment app. Seesail Outreach never receives or stores your card, bank, or payment-app credentials.
• Billing cycle & renewal. Subscriptions are billed in advance for the period you select. Your allowance refreshes at the start of each billing period.
• Cancellation. You can cancel your subscription at any time from Settings → Billing. Cancellation takes effect at the end of the current paid period, and you keep access to paid features until then. We do not charge cancellation fees.
• Price changes. If subscription prices change, the new price applies from your next billing period, with advance notice as described in Section 12.
• Refunds. Except where required by applicable law, payments are non-refundable once a billing period has started. If you believe you were charged in error, contact us (Section 14) within 14 days of the charge and we will review it in good faith.
