These Terms of Service govern your use of seesail.net, a SaaS platform for TikTok content creation and video publishing.
1. Service Description
seesail is a SaaS platform that provides the following features to TikTok content creators and e-commerce sellers:
- AI-powered content creation tools — including video clip selection and curation tools and AI-assisted video generation tools, enabling users to prepare short-form video content
- Video publishing via TikTok Content Posting API — after you grant authorization, seesail can upload videos to your TikTok account as drafts (video.upload) or publish them directly (video.publish), but only on your explicit instruction
- TikTok account connection via Login Kit — allows seesail to identify your TikTok account (display name, avatar) to associate publishing actions with the correct account
- Creator discovery and collaboration management via TikTok Shop Partner API — search for creators, send affiliate collaboration invitations, and monitor your own shop's performance analytics
Important: seesail is an independent service and is not affiliated with, endorsed by, or sponsored by TikTok or ByteDance Ltd. Use of TikTok APIs through seesail is subject to TikTok's own Terms of Service.
2. Eligibility
To use seesail, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding agreement under the laws of your jurisdiction
- Hold a valid TikTok account (or be legally authorized to manage one)
- Agree to comply with TikTok's applicable Terms of Service, Community Guidelines, and Developer Terms
3. Account & Authorization
- You may only connect TikTok accounts that you legally own or have been explicitly authorized to manage by the account holder.
- If you manage multiple TikTok accounts, each account holder must individually complete the OAuth authorization flow. You may not authorize accounts on behalf of others without their explicit consent.
- You are responsible for keeping your seesail credentials secure. You must notify us immediately at Mio13266737796@gmail.com if you suspect unauthorized access to your account.
- You may revoke seesail's access to your TikTok account at any time via seesail Settings or via TikTok's Connected Apps Settings.
4. Acceptable Use
By using seesail, you agree to comply with all applicable laws and the following rules.
4.1 Platform Policy Compliance
- You must comply with TikTok Community Guidelines, TikTok's Content Posting API Terms of Service, TikTok Shop Partner API Terms of Service, and all other applicable TikTok developer policies at all times.
4.2 Prohibited Content
You must not use seesail to upload, publish, or distribute content that:
- Contains violence, gore, or graphic content that violates TikTok Community Guidelines
- Is sexually explicit or pornographic
- Constitutes misinformation, disinformation, or synthetic media (deepfake) without appropriate disclosure
- Infringes the intellectual property rights of any third party, including unauthorized use of copyrighted music, video clips, images, or trademarks
- Contains hate speech or incites discrimination or violence
- Promotes illegal products, services, or activities (including prohibited substances, counterfeit goods, or financial fraud)
- Constitutes undisclosed paid promotion or advertisement in violation of TikTok's advertising policies
- Violates any applicable national or international law or regulation
4.3 Prohibited Behaviors
- No spam or low-quality bulk publishing — you must not use seesail to publish large volumes of repetitive, automatically generated, or low-quality content designed to game platform algorithms
- No engagement manipulation — you must not use seesail to artificially inflate views, likes, followers, or other engagement metrics
- No fake account operations — you must not use seesail to operate networks of fake, purchased, or inauthentic TikTok accounts
- No harassment of creators — seesail's creator discovery and invitation features must not be used to spam, harass, or inappropriately contact creators
- No reverse engineering or circumvention — you must not attempt to reverse-engineer seesail, bypass rate limits, circumvent security measures, or access seesail's systems in any unauthorized manner
- No scraping — you must not use seesail or any API access it provides to scrape TikTok platform data beyond what is returned by authorized API calls
- No redistribution of API data — you must not resell, sublicense, or redistribute any data obtained via TikTok APIs to third parties
5. User Content & Intellectual Property
5.1 Your Ownership
You retain all intellectual property rights in the content (videos, audio, images, captions, thumbnails, and other materials) that you create, upload to seesail, and publish to TikTok via seesail.
5.2 License to seesail
By uploading content to seesail for publishing, you grant seesail a limited, non-exclusive, royalty-free, revocable technical license solely to process, transcode, store temporarily, and transmit your content to TikTok for the purpose of executing your publishing instruction. This license terminates once the publishing action is complete or abandoned. seesail does not claim ownership of your content.
5.3 Your Responsibility for Content
You are solely responsible for ensuring that:
- You own or have all necessary rights, licenses, consents, and permissions for the content you publish, including video footage, music tracks, sound recordings, images, and any featured individuals
- Any music or audio included in your content is properly licensed for commercial use on TikTok (e.g., through TikTok Commercial Music Library or a separately obtained sync license)
- You have obtained any required model releases or publicity rights clearances for individuals appearing in your content
- Your content complies with all applicable laws, including advertising disclosure requirements
seesail is not responsible for any copyright infringement, rights clearance failures, or legal claims arising from content you publish.
5.4 DMCA / Copyright Infringement Notices
If you believe that content published through seesail infringes your copyright, please send a written notice to Mio13266737796@gmail.com containing: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the infringing content with sufficient detail for us to locate it; (c) your contact information; (d) a statement of good faith belief; and (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act. We will respond within 24–48 hours of receipt.
6. Authorization Scopes
seesail requests only the minimum TikTok API scopes necessary for the features you actively use:
- Login Kit (user.info.basic) — to identify your TikTok account
- Content Posting API (video.upload / video.publish) — to upload drafts or publish videos on your behalf
- Shop Partner API scopes — seller (shop info), creator (public creator profiles), analytics (your own store data), and collaboration (invitation management) — only requested if you use those features
You may review and revoke individual scopes at any time through seesail Settings, or by visiting TikTok's Connected Apps Settings.
7. Service Limits
- API write operations: Rate limits apply per tenant per minute, consistent with TikTok API constraints and seesail's fair use policy. Limits may vary by subscription plan.
- Batch collaboration invitations: Limited to ≤ 50 creators per API call, as imposed by TikTok's Shop Partner API.
- Video file size and format: Subject to TikTok's Content Posting API specifications.
- Availability: seesail is provided "as is" without uptime guarantees. Scheduled maintenance will be announced in advance where reasonably practicable.
8. Disclaimers
- seesail is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We do not guarantee the availability or reliability of TikTok's APIs. Disruptions to TikTok's services — including API outages, rate limit changes, or policy updates — may affect seesail's functionality.
- We make no guarantees about the performance of published content — views, engagement, follower growth, or sales outcomes are outside our control.
- We make no guarantees about creator acceptance rates for collaboration invitations.
- TikTok API data (GMV estimates, follower counts, engagement metrics) is provided by TikTok and reflects what TikTok exposes through its APIs. We do not modify or verify this data.
9. Limitation of Liability
To the maximum extent permitted by applicable law, seesail and its operator shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of goodwill, or business interruption
- Damages arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages
- Any claims arising from content you create, upload, or publish using seesail
- Any actions taken by TikTok, including account suspension, content removal, or API access revocation
In jurisdictions that do not allow exclusion of certain warranties or limitation of certain liabilities, our liability will be limited to the maximum extent permitted by law. Where mandatory consumer protection laws apply (including those in the EU or other applicable jurisdictions), they are not excluded by these Terms.
10. Termination
10.1 Termination by You
You may cancel your seesail account at any time via Settings → Account. Upon cancellation:
- OAuth tokens for all connected TikTok accounts are immediately revoked
- Personal data is deleted as described in our Privacy Policy
- Purge of OAuth tokens completes within 30 days of account closure
- Historical invitation records are anonymized but may be retained for up to 2 years for compliance purposes
10.2 Termination by seesail
seesail may suspend or terminate your account if you violate these Terms or TikTok's applicable policies. We will provide written notice where reasonably practicable before taking action, except in cases of serious or repeated violations.
11. Governing Law & Disputes
These Terms are governed by the laws of Thailand, without regard to its conflict of laws provisions. Any dispute arising from or relating to these Terms or your use of seesail shall be subject to the exclusive jurisdiction of the competent courts of Thailand.
Nothing in this clause affects any mandatory consumer protection rights you may have under the laws of your home jurisdiction (including, where applicable, EU consumer protection laws).
12. Changes to These Terms
We may update these Terms from time to time. For any material change — such as changes to acceptable use rules, liability provisions, or termination conditions — we will:
- Post an in-app notification banner at least 14 days before the change takes effect
- Send an email notification to your registered address at least 14 days in advance
Your continued use of seesail after the effective date of updated Terms constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using seesail and cancel your account.
